Agreement to Terms
By accessing or using the services provided by FoodiPie, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access or use our services.
Services Description
We provide web development, design, and related digital services. Our services include but are not limited to:
- Website design and development
- E-commerce solutions
- Custom web applications
- Website maintenance and support
- Hosting and domain services (where applicable)
User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:
- Maintaining the security of your account and password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring that your account information is kept up to date
Payment Terms
Payment terms are as follows:
- All prices are in the currency specified at the time of purchase
- Payment is due according to the terms of your selected plan
- We accept payment through secure third-party payment processors
- Refunds are subject to our refund policy (see below)
- Late payments may result in service suspension or termination
Refund Policy
Refund requests must be submitted within 30 days of purchase. Refunds are subject to review and may be granted at our discretion based on the circumstances. Custom development work that has been completed may not be eligible for a full refund. Please contact our support team for refund inquiries.
Intellectual Property Rights
The service and its original content, features, and functionality are owned by FoodiPie and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Upon full payment, you will receive ownership rights to the custom-developed website or application as specified in your service agreement. However, we retain the right to use general design patterns, code libraries, and methodologies developed during the project.
User Content
You are responsible for the content you provide, including text, images, and other materials. You warrant that you have the right to use and authorize us to use such content. You agree not to submit content that is illegal, offensive, or violates any third-party rights.
Prohibited Uses
You may not use our services:
- In any way that violates any applicable law or regulation
- To transmit, or procure the sending of, any advertising or promotional material
- To impersonate or attempt to impersonate the company or any employee
- In any way that infringes upon the rights of others
- To engage in any other conduct that restricts or inhibits anyone's use of the service
Service Availability
We strive to ensure our services are available 24/7, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice. We are not liable for any loss or damage resulting from service interruptions.
Limitation of Liability
To the maximum extent permitted by law, FoodiPie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.
Indemnification
You agree to defend, indemnify, and hold harmless FoodiPie and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of our services or violation of these Terms.
Termination
We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the services will cease immediately.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FoodiPie operates, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
